Two face dangerous driving causing death

Two men have appeared before Londonderry Magistrate's Court in connection with the death of a Waterside pensioner in April, 2013.

David Richie (69), from Tullyally, died as a result of the collision on the Glenshane Road close to Burntollet Bridge.

In the dock was Thomas Andrew Hyndman (25), of Knockbrack Road, Ardmore, who was charged with causing Mr Richie’s death by dangerous driving and driving without insurance.

Also before the Court was Stephen Edward Joseph Magee (33), with an address at Ivy Mead in the Waterside.

He also faces a charge of causing death by dangerous driving.

During the preliminary inquiry into the case counsel for the defendants said it was accepted there is a prima facie case to answer. Both men stated that they did not wish to call any witnesses or present any evidence at this stage in the case.

Patrick McDaid, who appeared for Hyndman asked for extra counsel in light of the charge of causing grievous bodily injury to his co-defendant Mr Magee, but it was refused by the District Judge, Barney McElholm, who said he did not consider that situation to be substantially complex.

Both Hyndman and Magee were released on their own bail of £500 to reside at their given addresses. They will return to the Magistrate’s Court on March 8, for arraignment.
